These Terms of Service (“Terms”) govern your access to and use of the Nootropical website, products, and services (the “Services”). Throughout these Terms, “Nootropical,” “we,” “us,” and “our” refer to Nootropical. By accessing our website or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
Use of the Services
You must be the age of majority in your place of residence to use our Services. You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. You may not misuse, disrupt, or attempt to gain unauthorized access to the Services or related systems.
We reserve the right to refuse service, suspend access, or terminate accounts at our discretion if we believe these Terms have been violated.
Products, Orders, and Payments
All products are offered subject to availability. Prices, descriptions, and availability may change at any time without notice. We reserve the right to limit or cancel orders, including those that appear to be placed by resellers or distributors.
Payments are processed through third-party payment providers. We do not store full payment card details. Please review our Refund Policy for information about returns and exchanges.
Communications and Messaging
By providing your contact information, you agree that we may contact you regarding your orders, account activity, customer support requests, and other service-related communications.
You may receive transactional or service-related emails from us. If you opt in to marketing emails, you may unsubscribe at any time using the link provided in our emails. Unsubscribing from marketing emails does not affect service-related communications.
Mobile Terms of Service
The Nootropical mobile message service (the "Service") is operated by Nootropical (“Nootropical”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Nootropical’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Nootropical through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Nootropical. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18447795912 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Nootropical mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

SMS and Mobile Messaging
This section summarizes the SMS terms above and applies to all SMS programs operated by Nootropical.
By opting into SMS from a web form, checkout, or other medium, you agree to receive text messages from Nootropical. These messages may include customer care, order or account notifications, and marketing or promotional messages, depending on what you opted into. Message frequency varies. Message and data rates may apply.
You can opt out at any time by replying STOP. For help, reply HELP or contact us at team@nootropical.com. Consent to receive SMS messages is not a condition of purchase.

Intellectual Property
All content on the Services, including text, graphics, logos, images, and software, is owned by or licensed to Nootropical and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or exploit any content without our prior written permission.
Third-Party Services and Links
Our Services may include links to or integrations with third-party websites or tools. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk and subject to their terms.
Disclaimer of Warranties
The Services and all products are provided on an “as is” and “as available” basis. We do not guarantee that the Services will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
Limitation of Liability
To the fullest extent permitted by law, Nootropical will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products, even if we have been advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless Nootropical and its affiliates, officers, employees, and service providers from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict of law principles.
Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on this page with the updated date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
